Terms of Service

These terms govern your use of Waarp. Please read them carefully. They cover your responsibilities when recruiting and interviewing people, how fees work, and the limits of what our AI-generated results can promise.
1. Agreement to these terms
These Terms of Service (the “Terms”) are a binding agreement between you and Waarp (“Waarp”, “we”, “us”) and govern your access to and use of the Waarp website, application, and services (the “Services”). By creating an account or using the Services, you agree to these Terms. If you are using the Services for an organization, you represent that you have authority to bind that organization, and “you” means that organization.
2. What Waarp does
Waarp helps you validate a product idea by running autonomous customer-discovery interviews. You set up a campaign; people opt in; an AI voice agent calls each interviewee, by phone or in the browser; and Waarp records, transcribes, and analyzes each interview, returning per-interview results and campaign-level briefs. The Services are provided on an ongoing, evolving basis and features may change.
3. Eligibility and accounts
You must be at least 18 years old to use the Services. You are responsible for your account, for keeping your credentials secure, and for all activity under your account. Notify us promptly at legal@waarp.io if you suspect unauthorized use.
4. Your responsibilities when running interviews
You direct who is recruited and interviewed, and you are responsible for doing so lawfully. In particular, you agree that:
- You will only interview people who have opted in, and you will not upload contact lists you are not authorized to use.
- You are responsible for complying with laws that apply to contacting and recording people, including call-recording and consent laws (some jurisdictions require every party’s consent), telemarketing and automated-calling rules, and anti-spam laws, wherever your interviewees are located.
- You have any legal basis and permissions required to collect and process your interviewees’ personal information through the Services, and you will honor their privacy rights.
- You will not use the Services to harass, defraud, or mislead people, to collect sensitive information you are not permitted to collect, or for any unlawful, deceptive, or harmful purpose.
- Your campaign content will not infringe others’ rights or violate any law.
You are the controller of the interviewee personal information you collect through the Services, and Waarp processes it on your behalf as described in our Privacy Policy.
5. Acceptable use
You will not misuse the Services. This includes not attempting to disrupt or gain unauthorized access to the Services, not reverse-engineering or copying the platform, not reselling the Services without our permission, and not using the Services to build a competing product or to send spam or malicious content.
6. AI-generated output
Transcripts, verdicts, scores, and briefs are generated by automated systems and large language models. They may be inaccurate or incomplete and are provided to support your own judgment. You are responsible for how you use them; they are not professional, legal, financial, or investment advice, and Waarp does not guarantee any particular result or that an idea validated or invalidated by the Services will succeed or fail.
7. Fees, billing, and credits
Paid features are billed as described at checkout and on our pricing page: pay-as-you-go per completed interview, or a subscription. Payments are processed by Stripe, and you authorize us to charge your selected payment method. Fees are stated exclusive of taxes, which you are responsible for. Except where required by law or expressly stated, fees are non-refundable. We may change pricing prospectively; changes will not affect purchases already made.
8. Your content and data
As between you and Waarp, you own your campaign content and the interview data and results generated for your campaigns (“Customer Data”). You grant Waarp a worldwide, non-exclusive license to host, process, and use Customer Data to provide and secure the Services. We may also use aggregated or de-identified data, which does not identify you or your interviewees, to operate and improve the Services.
9. Waarp’s intellectual property
The Services, including the software, models, design, and brand, are owned by Waarp and its licensors and are protected by intellectual-property laws. Except for the rights expressly granted to you, we reserve all rights in the Services. “Waarp” and our logos may not be used without our permission.
10. Third-party services
The Services rely on third-party providers, including telephony, speech, AI-model, payment, and cloud-hosting providers. Your use of the Services may also be subject to those providers’ terms. We are not responsible for third-party services we do not control.
11. Disclaimers
The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any interview, transcript, or verdict will be accurate or complete.
12. Limitation of liability
To the maximum extent permitted by law, Waarp and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid Waarp in the three months before the event giving rise to the claim, or one hundred U.S. dollars ($100).
13. Indemnification
You will defend, indemnify, and hold harmless Waarp from claims, damages, and costs (including reasonable legal fees) arising from your campaign content, your use of the Services, your violation of these Terms or applicable law, or a claim by an interviewee or third party relating to how you recruited, contacted, recorded, or used data about them.
14. Termination
You may stop using the Services and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required for security or legal reasons, or if we discontinue the Services. On termination, your right to use the Services ends; sections that by their nature should survive, including data ownership, disclaimers, limitation of liability, and indemnification, will survive.
15. Governing law and disputes
These Terms are governed by the laws of Texas, without regard to its conflict-of-laws rules, and any disputes will be resolved in the courts located in Texas, unless applicable law requires otherwise.
16. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, for material changes, provide a more prominent notice. Your continued use of the Services after an update means you accept the revised Terms.
